How to file against a Retailer asking for more than MRP

Hi,

Recently i had a fight with the shop named "BIMALA SWEETS" in Tech market ,IIT kharagpur.The shop owner asked for more than MRP amount for a cool drink,saying the extra amount is for COOLING :-) :-).

This may appear to be normal to any Indian.But this is illegal,they are actually looting you and also they will not give any receipts.I got fed up with this and wanted to file a complaint against them as an educated individual.

These are my following findings

STEP 1)

Indian Laws: Conditions for Charging above MRP

If a retailer or service provider charges you more than MRP while providing home delivery service, do not pay him the extra money. Remember that if you are ordering stuff at home, you are not utilizing any service of the service provider. The National Consumer Disputes Redressal Commission has ordered that consumers cannot be charged more than the MRP during home delivery services as they are not utilizing any service.  An extra amount can only be charged in restaurants where additional services are provided. So, consumers should be aware of their rights under the Consumer Protection Act, 1986. These rights also enable the consumer to get back the extra money, along with the compensation.

Under the Indian Laws, the following provides consumer protection:

• Central Consumer Protection Council
• State Consumer Protection Council
• District Consumer Information Centre
• District Consumer Protection Council
• Consumer Complaint Cells of Business Chambers & Traders’ Associations

Indian Laws: How to File a complaint?

File a complaint on a plain paper, in triplicate, at the seller’s place to the District Consumer Disputes Redressal Forum within 2 years from the date of the cause of action.

You must mention the following information in the application form:

• Your name along with address
• Name along with address of the party against whom the complaint is being filed
• Description of goods or services
• The price charged
• Quantity purchased by you
• The date of purchase
• Any proof available of purchase
• Required type of redressal

STEP 2)  

Then go to the site http://www.ncdrc.nic.in/ and select "District forums" to search for the address of the office and complaint abt the issue.

It will be addressed within 90 days .The government has all the facilities ,its upto us to get the right

DREAM LAND!! is it really what it meant to to be??

Hey there,this blog is about an incident happened in a hotel DREAMLAND inside IIT Kharagpur.It is one of the Hotels which IITians hang out to escape from the Mess food.Now lets get to the floor

I was having a pretty bad day roaming outside IIT to search for a decent hotel.It went in vein and finally chose to come back into IIT to have lunch.Then,I thought its better to go back to Mess than eating in any of the hotels where the taste is pretty much the same .Since I thought of going to hotel first,my heart didnt allow me to pass that hotel without treating my taste buds.So,I stoppped my Karizma (cycle) there and went in.I was welcomed by a guy in the counter and I ordered "Amul Cool".The guy picked it from the fridge, opened it and kept it in front of me.Then I remembered that I had only Rs.500 note and not any change,so asked whether he has any change.He didnt even look at me and started searching something in the dustbin near the counter.I thought he didnt hear me and tried to say to the best possible way I can "ACTING OUT".Then I saw a 100 watt light in his face.I thought he understood what I said,but he slowly picked the Bottle cap he found in the dustbin and covered the opened "Amul Cool" with it.

I just want to post it to let the awareness spread across people to know about the products they buy and most importantly from who :-).

Unusually today I believed in God and prayed that Sun should never arise next day. It was a big night for me . Even the stars seemed like stabbing me in the back. My heart was crying , and even the chill air felt like a ball of fire pushing me to death .Tomorrow will be one of the difficult situation I will ever experience in my life. Tomorrow is February 14 , that’s not a problem, the problem is tomorrow is her marriage .It happened all of a sudden and I am the loser.

We had a great life till that incident happened. It happened 6 months ago and everything changed suddenly. She started coming home late from office, even she went out on weekends without me .We used to watch at least 5 movies a week before ,now she didn’t even have time to have lunch with me. I can see this happening, I am losing here day by day, and I couldn’t do anything to stop her . From tomorrow everything will change forever.

Finally the D day arrived; it was a bright sunny day with lots of sunshine in the sky and lots of smile in the guests face. Its sure was a beautiful day , but for me I haven’t even been invited for this marriage .Anyway I am here .I am seeing every moment of her marriage and my eyes start to float in the pond of tears. Marriage happened with loads of laughter around the Bride and the groom and I can see happiness in her eyes.

After Marriage every one of the guests started to give Gifts to the newly wed. One of the elderly came to me and said “hey, how is your new bother-in-law, and the bride, your sister looks so beautiful today as ever”

2 week Laptop!!!

Hey there,I was wondering why I am not as much productive while doin MBA than I was at work.After a deep introspection, I came to know the main culprit-'Thats ofcourse me :-)',and for the question WHY? the answer must be a series of things ,but in my case it was a single gadget-LAPTOP!!.Thank God I am not using Cellphones much these days,thanks to a bit costly STD rates. I want to share with you how a LAPTOP came into my hand.

It was one of my dream to do MBA in a good B school . I got admission in one after a long fight for 3 years.The phase after the admission phase is called as "Expense" Phase,where a series of expense happens like Fees,Suits,Cycles,Books and one expense which made me mad for the 2 weeks before admission is LAPTOP.

I Got admission in Vinod Gupta School of Management,IIT Kharagpur just 2 weeks before the joining date. The next mail I got after my admission mail is the prerequisites for MBA. I started to finish one by one and finished buying most of them in 2 days. Finally I had 2 things to do ,first buy a laptop and second Medical certificates. Seeing a big gap (10 days) before admission,I went for a big bargaining spree for buying Laptops . I was inquiring about Laptops in about 12 stores in and around Chennai per day for 3 days and still didnt get the best deal.Then I saw a Laptop Expo near ,y house which changed it all!!

Laptop Expo happened near my house in Tnagar,Chennai.Surprisingly the price mentioned befor e Laptops were quite expensive than any other store in the locality,but I saw a long queue before the managers desk.Suddenly a guy tapped me in my left shoulder and asked me "are you interested in Samsung Laptops" ,nah he is not a astrologer,I was standing in front of a Samsung Laptop :-) . I said "Yes, but the price is high".He smiled and took me to a new manager who arrived just now .I was asked "what was the cheapest price you saw in the locality".Actually at that time I zeroed in on DELL 14 Inspiron,I said that the Brand is Dell Inspiron and the price is Rs.32,000.The manager responded sayinh,"You must have a visited a wholesaler nearby,OK I will give it for Rs.31,500.Also,I think this might surprise you ,a Samsung Laptop which specification is far more superior than ur DELL 14,but it costs Rs.30,000 as it is fairly new to the market,what say??". I replied that I will be back tomorrow and got their business card.

Thats it!!! I didnt sleep that night also thinking about the laptop which I gonna buy.Samsung is fairly new but no reviews and is cheap.Dell is a bit costlier ,nice review and reputed.Finally I deided to Buy DELL from expo and I asked money from my MOM.

SUDDENLY A TWIST!!!

I didn't expect that twist at that time,she was running short of money and I had no alternative but to buy it from an EMI shop.I know a a guy,who used to sell gadgets for EMI and he gives it very cheap.He was trading on INTEREST amt.I went there and I got awestruck seeing the "0%" interest on top of the shop . I went in there and stroke a deal with him for Dell 14 laptop for Rs.31,000.The only problem with him is that ,you cannot get it at the time of ordering . We have to wait 2 -3 days for getting the product..He is kind of using JustInTime inventory and has to get it from supplier.

I didnt pay the money as I had a deal of paying it at the time I took my laptop to my home,giving the necessary document.As I had many transactions with him he agreed.I waited for 1 week to get it and finally that store was closed for 2 days in a row.And he was also not picking up the phone.

Finally 2 days before joining ,I was frustrated and forced my Dad to give the money .I went back to see the Expo and was disappointed seeing an emoty ground.Then, I called his card number and was cornered as the expo was over he can give it only for Rs.32,500 and with no other choice in line and with only 2 days to go,I bought it there :-)

THe 2 weeks went in vein for me buying the laptop.But i learnd the first step in MBA,A bird in hand is worth 2 in a bush :-)
